CITY OF AMMON
March 2, 1977
Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7: 30 p. m. by Council President Russell N.
Swensen, with the following City Officials present:
Councilman Russell N. Swensen Clerk Deon Hemingway
Councilwoman Carol A. Dille Asst. Attorney Douglas R. Nelson
Councilman Francis Lee Asst. Engineer Robert Butler
Councilman Marvin J. Anderson Maint. Supv. LaVern E. .Williams
Not present: Mayor George Wehmann - out of town
Also present during the meeting was C. Jordan Smith, Sales Representative of
Boyd Martin Company.
The pledge of allegiance to the flag was conducted by Councilwoman Dille and the
invocation was offered by Councilman Lee. Minutes of the previous meeting were
not ready for approval.
Inasmuch as it has been determined that the City will accept credit rather than
having the lawn mower repaired which was badly damaged in an accident last fall,
C. Jordan Smith of Boyd Martin Company was given time to present cost and per-
formance information on several mowers which he felt would meet the City's
needs. He pointed out that, if the City were to purchase the Hustler mower which
was left here several months ago, it could be paid for by the insurance settlement
plus the credit allowance on the damaged mower. However, if a larger mower is
desired, financing arrangements can be made without interest if the balance is
paid within the next two years or with interest if payments need to be spread out
over a longer time. He made note that there is to be an increase in the cost of
mowers 'from the factory after February 10th, so it would be to the city's advantage
to make a decision before that time. Councilman Lee moved to accept the pro-
posal from Boyd Martin Company ',on a Jacobsen F-10 5-gang Fairway Mower with'
the price as quoted of $11,690 less $700 credit on the wre.cked F-133 mower less
an additional discount of $612 leaving a balance of $10, 378, with payments to be
worked out after further discussion with the Mayor and City Council. The motion
was seconded by Councilman Amerson; voting was all in favor; motion carried.
Mr. Smith said that he would place the order at the factory and would expe~t to
be notified by Monday of next week about the final decision.
COMMITTEE REPOR TS
Mayor (Council President) - Councilman Swensen made note of a reminder from
Mayor Wehmann that the notice of public hearing on the Revenue Sharing Budget
which is to be at the next regular meeting on March 16 needs to be in the news-
paper as a news article within the next few days (on or before March 9).
Fiscal Ope'rations - According to a report by Councilman Swensen, explanation
has been obtained from John Homer, the City's insurance agent, that the check
for $3, 454. 52 which was sent in settlement of the claim on the damaged lawn mOWer
represents the amount of the repair estimate given to the insurance company by
Boyd Martin Company of $3,704.52 (which is a little less than the figure given to
the City) les~ $250.00 deductible which was agreed upon in order to reduce the
premium when the insurance was reviewed last year, so it would appear that this
setHement should be accepted. Regarding temporary use of land belonging to Horace
Smith for a turnaround at the east end of Circle S. Drive, Councilman Swensen
reported that Mr. Smith has been contacted and he feels that this would take too
much of his land"so he is not willing to give the City permission to put in the re-
quested turnaround. Inasmuch as this means that the hazardous condition will
still exist when the garbage truck has to be backed up on that street, it was
decided that no parking on the block would eliminate some of the problem, so
Engineer Butler agreed to take some width measurements on Circle S Drive to
determine if the parking restriction regulation would be enforceable there. Council-
man Swensen indicated that he is still working on getting sane pamphlets on energy
conservation to distribute to the people of Ammon.
Planning and Zoning - It was reported by Councilwoman Dille that the notice has
been published for the public hearings to be held by the Planning and Zoning Com-
mission on March 15, but there will be no hearing on March 8 since the developer
of the proposed Westwood Addition did not get the legal description in on time.
