Council Minutes 03/18/2002 CITY OF AMMON March 18, 2002 Minutes of the Special Meeting of the Mayor and City Council: The meeting was called to order by Mayor C. Bruce Ard at 5:05 P.M. in the City Building, 2135 South Ammon Road, Ammon, Idaho, with the following City Officials present: Mayor C. Bruce Ard Councilmember W. Lee Bean Councilmember Karen Y. Anderson Councilmember Randy G. Waite Attorney W. Joe Anderson Engineer Bill Manwill Public Works Director David Wadsworth City Clerk Aleen C. Jensen Others Present: No One The purpose of the Special Meeting was to adopt floodplain management measures that satisfy the requirements of Section 60.3(c) of the National Flood Insurance Program (NFl)) regulations. These measures must be adopted by April 2, 2002, to avoid our community's suspension from the NFIP on that date. The Federal Emergency Management Agency (FEMA) completed a flood insurance study for the City of Ammon and revised the Flood Insurance Rate Map. Basically the Peterson Park Subdivision has been taken out of a designated flood prone area. The City Council reviewed the revised map. Attorney Anderson introduced Resolution No. 2002-02, ADOPTING BY REFERENCE TO THE FLOOD PLAIN ORDINANCES THE REVISED PRELIMINARY FLOOD INSURANCE STUDY AND FLOOD INSURANCE RATE MAP AND FLOOD CONTROL STUDY DATED APRIL 2, 2002 SUBMITTED BY FEDERAL EMERGENCY MANAGEMENT AGENCY. Council member Bean moved to accept Resolution 2002-02 to adopt by reference the revisions to the flood plain ordinances. Councilmember Anderson seconded the motion. Roll call vote: Bean - Yes; Anderson - Yes; Waite - Yes. The motion carried. Attorney Anderson introduced Ordinance No. 306 by title, AN ORDINANCE TO AMEND ORDINANCES NUMBER 191, 216 AND 232 FOR THE CITY OF AMMON, BONNEVILLE COUNTY, IDAHO; CODIFIED IN THE CODIFIED ORDINANCES OF THE CITY OF AMMON, IDAHO AS TITLE 7 CHAPTER 10, TO ADD A SECTION DESIGNATED AS 7-10-8 TO PROVIDE FOR THE INCORPORATION WITHN THE AMMON ORDINANCES OF THE FLOOD INSURANCE STUDY FOR THE CITY OF City Council Meeting, March 18, 2002 - Page 2 AMMON, DATED APRIL 1,2002, AND ANY REVISIONS THERETO; PROVIDING FOR AN EFFECTIVE DATE. The ordinance was read in full. Councilmember Anderson moved that the City Council dispenses with the rule requiring the reading of the ordinance on three different days and that the three readings of Ordinance NO. 306 be waived. Council member Bean seconded the motion. Roll call vote: Anderson - Yes; Bean - Yes; Waite - Yes. The motion carried. Council member Anderson moved the adoption of Ordinance No. 306 as an ordinance of the City of Ammon on its third and final reading. Councilmember Waite seconded the motion. Roll call vote: Anderson - Yes; Waite - Yes; Bean - Yes. The motion carried. The City Council Meeting scheduled for Thursday, March 21, 2002 was cancelled because of lack of quorum. Public Works Director David Wadsworth discussed Bach Developments' proposed apartment complex behind Edwards Theater. David has had a number of discussions with Tony Gonzalez, Development Manager, about putting meter pits on each building instead of putting an eight (8) inch meter out in the middle of the street. Now Tony is trying to work up cost estimates for the project. When he came to the City Office recently, he was advised he would need to pay for an eight (8) inch connection fee instead of connection fees for smaller lines into each individual building from the eight (8) inch line. Tony is going to fax detailed information on his plans, and he wants certification from the City on the amount of the connection fees. The present understanding is: (1) Reroute the ten (10)" inch main line at Bach's expense; (2) Bach will install an new eight (8) inch line off the ten (10) inch line across the Bach property. This is to be a private line to be maintained by the developer except for the fire hydrants; and (3) Pay connection fees for a line into each building. If he runs two lines into each building, he pays connection fees for two lines. If he runs one line into each building and splits it off into two lines, that is one connection fee. There will be a meter for each building. This is more cost effective for the City than one eight (8) inch meter. The connection fees are according to "Water Line Connection" on page 7 of Resolution No. 2001-06. Councilmember Bean asked if we were finished on the annexation of the Wal-Mart property. Attorney Anderson advised we will probably amend the ordinance to correct the legal description to include the location of the access roadway. However, if Wal- Mart gets an easement for an access from City of Idaho Falls or from the State, we will not need to annex any additional property or make any adjustments. There was a discussion on Wal-Mart plans and their access options. Basically they are back to the original alignment with a slight sift for the power poles. There will be two signal lights- one on Curlew and one at the Eastern Idaho Technical College/Wal-Mart entrance with modifications to the signal light at Hitt and 1 ih. Any further action by the City Council is conditioned on Wal-Mart closing on the property. City Council Meeting, March 18, 2002 - Page 3 Engineer Manwill gave an update on the Sunnyside Road project. The Signal/Hitt Intersection Project appears to be continuing on schedule. It still looks like it will go out to bid so construction can begin in August. It could go to bid as late as August, but it should be built before winter hits us. Bonneville County was caught off guard when the City of Idaho Falls submitted to the County for advertising the Sunny Heights frontage road and sidewalks. This is in the federal aid limits but probably beyond where they will end up building because they will run out of money. It will be advertised for bid, and they will have to decide who pays. Details of the project were reviewed. Councilmember Anderson asked if anyone had been thinking about the new Legislative District boundaries. She had heard rumors that the newest lawsuit may not be successful. One district is an island of Idaho Falls, and another district completely surrounds it like a donut. Most of Ammon is in the donut or District 32. All the new annexations of The Cottages and Quail Ridge are in a district involved in the lawsuit that encompasses an area from Teton County to Franklin County. Claims were approved. Council member Bean moved to adjourn the meeting, and Councilmember Anderson seconded the motion. The meeting was adjourned at 6:00 P.M. Mayor Attest: City Clerk
