newspaper as required by law. The motion was seconded by Councilman Swensen;
voting was all in favor; motion carried.
Councilman Lee asked Engineer Benton if the work on the French Drain on Geneva
Drive is satisfactory, and was told that the job has been done according to speci-
fications except for the street repair, so partial payment is recommended at this
time. With reference to the sewer lines which need to be put in, Councilman Lee
reported that the property owner at 1890 Eagle Drive has requested an extension to
June 23.
Bonneville Council of Governments - According to Councilman Swensen,. all elected
officials are invited to the next meeting of BCOG scheduled for 7: 30 A. M. June 2,
1976, since information- on joining the Economic Development District will be dis-
cussed at tha.t time.
Attorney - In response to an inquiry by Mayor Wehmann, Attorney Anderson in-
dicated that the bonds for Local Improvement Dis.tricts No. 6 and No. 7 are to be
printed at the same time when the remainder of the work on L.1. D. No. 7 is com-
pleted.
Engineer - In the matter of working out a plan to start action on correcting the
sidewalk and curb and gutter problems that have resulted from the installation
of the sewer system, Engineer Benton stated that he would make arrangements
for Bob Butler and a representative of H-K Contractors to mark the locations
of the problems where it has already been determined ar-e the' responsibility of
the contractor (this is to be done by.June 10), then the others can be inspected
and contractor or city responsibility decided before the cement repair is done.
Reference was made to a routine water survey of the Ammon system made on
April 21, 1976, by Monty G. Marchus of the State Division of Environment,
and it was mentioned that the recommendation that a vacuum breaker be in-
stalled for the sprinkler system at Well #2 should be brought to the attention
of the L. D. S. Church, the owner of the sprinkler system.
Other Business
Gerald Connell, Bishop of the L. D. S. Ammon4th Ward, presented a proposal to
develop the city park in the Peterson Park subdivision by having the membership
of three wards furnish the labor as a Bicentennial Project. The Council indicated
approval of this activity, and requested that Engineer Benton make a cost estimate
for plowing and leveling so that it can be determined if the city has sufficient
funds for getting the ground ready for .planting. Mayor Wehmann recommended
that this estimate be prepared as soon as possible, then the Parks Committee can
make a decision without waiting until the next meeting.
Roland Romrell, of 3290 Molen St., inquired if the City had record of the exact
distance that the right-of-way for Romrell Lane was offset to the east a few
years ago when he bought property for that purpose so that the street would not be
right along side of his house. Engineer Benton agreed to check this out at the
County Recorder's Office. Mr. Romrell mentioned that he needs to have this
information in order to complete. his plans to put in a cement driveway and a fence.
Mr. and Mrs. Jerry Hoggan stated that they have purchased the very south lot in
Jennie Jean Estates which border on the City limits, and asked what would have to
be done in order to hook on to the City sewer system. They also inquired if they
would be reimbursed for the extra costs of the sewer line if the main line is ex-
tended as a City project in the future. It was explained that the sewer line in the
subdivision to the south of this location has not been accepted by the City yet, so
final permission cannot be given at this time, and that drawings will have to be
prepared and presented to the City Engineer of Idaho Falls for inspection the same
as for any other line. Councilwoman Dille moved that perm'ission be granted to Mr.
and Mrs. Jerry Hoggan to extend the City sewer line, at no expense to the Oty, on
Ross Avenue to serve Lot 1 Block 5, Jennie Jean Estates, if all engineering re-
quirements are met, and that consideration be given to making reimbursement
when the sewer main line is installed on beyond that point. The motion was seconded
by Councilman Lee; voting all in favor; motion carried.
Councilman Swensen moved to adjourn at

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order

The pledge of allegiance to the flag was led by Councilman Lee. The invocation
was offered .by Mayor Wehmann. Minutes of the meeting of May 19, 1976, were
approved as written.
Earl Foster of H-K Contractors informed the Council that the construction
schedule for the 17th Street Project is to start laying the prime coat the week of
June 7 and to begin the oiling work on June 21.
Wynn Pettingill, 3280 Circle S. Dr., pr-esented a claim for constructing six
batting tees for the City-sponsored Pee Wee Baseball as authorized by Councilman
Anderson, which was approved for payment.
COMMITTEE REPOR TS
Mayor - Information furnished by Gary Davidson, 1976 Ammon Days Chairman,
listing scheduled area activities was reviewed by Mayor Wehmann, and the
Council approved of his suggestion that the Ammon Days celebration be set for
Saturday, August 7. It was noted that a co-,chairman for that event has not yet been
named.
Mayor Wehmann presented a revised travel-allowance recommendation as follows I

Comments of the Attorney, Engineer, and Council members were invited by Mayor
Wehmann regarding the draft of a proposed Agreement for Cooperative Action
with the City of Idaho Falls for inspection of subdivision improvements. A few
suggestions for changes in the wording were made, and it was noted that the
agreement is subject to the review of the City of Idaho Falls Attorney before it is
drawn up into a more final form for further consideration.

Mayor Wehmann reviewed the City employee $ituation to the effect that two main-
tenance men have quit (Rayce McVey and, Bruce Storm) and have been replaced on a
90 -day probation period, with men that it is felt will be quite stable. According to
Mayor Wehmann, word has been received from the Employment Office that as many
as 11 young people can be employed at the City of Ammon on the summer CETA pro-
gram, and the Council members were asked to make suggestions about what work
needs to be done in the City that these youth can be assigned to do in addition to
the maintenance of parks.

Mayor W ehmann told the Council of a problemwhieh had come up recently as a
result of a Building Permit being issued to allow construction of a home workshop
in the backyard of property owned by Errol Smith at 1840 Eagle Drive. He explained
that the permit had been given to set the building 1 foot from the property line which is
allowed by the zoning ordinance, but without the City Clerk being aware that the prop-
erty owner should be advised not to construct a permanent building in the backyard
easement area and without a knowledge that there is a buried ~as line in the easement
involved. Since Mr. Smith had already poured footings for his building before it was
discovered that the gas line is under the location of the workshop, the gas company
agreed to re -route the line around the building at company expense with Mr. Smith
taking down and replacing the fence. Mayor Wehmann asked that the Attorney pre-
pare wording for a rubber stamp or a notice to be used with Building Permits to
inform the applicants of their responsibility .regarding easements. With reference
to Intermountain Gas Company, Attorney Smith mentioned that a reply had been
received from that company in response to an inquiry by the Attorney's office
indicating that there are no cities in the State of Idaho which receive more than 3%
of gross receipts (the amount that Ammon gets) on a gas franchise.
A report by Mayor Wehmann informed the Council that the pump at Well No.6 is
off, and the problem is being checked out by the contractor that installed the pump.
The pumps at the other wells have been turned on to keep the water pressure up.
It was pointed out .that consideration .is being given to connecting the alarm for
Well No.6 at the Idaho Falls sewer plant or some other place where personnel are
on duty at all times, and also to exploring the possibility of having the City of Idaho
Falls provide maintenance for Well No.6 only.
The fact that the sewer-metering device is still not in operation was brought to the
attention of the Council by Mayor Wehmann, who asked that Bob Butler of the City
Engineer's office continue to follow up on this matter.
Planning & Zoning - Nothing to report.
Parks and Recreation - Mayor Wehmann stated that he has been pushing Maintenance
Supervisor LaVern Williams to give No. I priority to getting the park sprinkling
systems on since the grass is very dry. He mentioned also that he has received
complaints about the dandelions in Lions Park, and recommended that spraying be
done, noting that he had obtained an estimate of $90 to do this work. With reference
to the plastic protectors on the tennis court lights, Mayor Wehmann reported that
they are melting and turning yellow, so will have to be removed. He suggested
replacing these covers with mesh wire. Councilman Anderson is to take care of
these matters and check to see if there will be a refund on the plastic protectors
which proved to not be resistant to the heat of the lights as claimed by the manu-
facturer of the product.
City Clerk - A .report by City Clerk Deon Hemingway listed a General Fund checking
account balance of $16,071. 65 and claims to pay in the amount of $6,762.81. Regard-
ing the 7 claims filed with the Small Claims Court in March on amounts due from
people who have moved Qut of the City, the Clerk reported that 4 of the defendents
mane payment in full directly to the City before the court hearing date, the court was
not able to locate one of the people to serve the papers, and 2 delendants failed to
appear at the court and judgments have been prepared against them which require follow-
up action by the City Attorney. The delinquent account for the Eastgate Mobile Village
was discussed, and it was decided that a letter from the Mayor should be sent to the
owner of the trailer court.
Police and Fire Department - Mayor. Wehmann mentioned that he has been informed
that a petition is being circulated requesting a 15-mile-per-hour speed limit in the
Hillview area. .According to Councilwoman Dille, a new organization called Idaho
Youth for Traffic Safety is being organized, and a request has been received to find
someone interested in serving on that committee. Reference was made to a complaint
received from David Peterson, 3790 Ross Avenue, about a littering problem at a
residence in the neighborhood, and Councilman Lee mentioned that the tickets which
are being considered to use for garbage collection violations will include a warning
about littering also. Attorney Anderson pointed out that there are 2 sections in the
Municipal Code on the subject of littering which can be enforced, and Mayor Wehmann
proposed to send a letter over his signature to the violator. The matter of livestock
animals in the entire backyard area at the residence of Louis Simcask, 3040 Rawson
St., was discussed, noting that the neighbor, Mrs. Terrence Jenson, 3030 Rawson St. ,
had filed a complaint, and that the situation had been brought to the attention of the

Health Department without any results. It was the feeling of the Council that
action should be taken to have the Simcasks comply with the zoning and police
ordinance regarding animals and that the neighboring property owners who have
animals should also be advised of the requirements of the ordinance.
Public Works - Councilman Lee reviewed the current status of the sewer hookup
list as follows: A contractor has been engaged to do the sewer connections at
2045 Dove Drive and 1900 Curlew, properties owned by Fred Blair, but sewer
permits have not been purchased yet. The home at 2080 Dove Drive is being re-
possessed from Dell Denning, so there is no action on that sewer at this time.
Wayne McKenzie of 3375 Rich Lane has obtained a permit and it is expected that
the work will be done shortly. An extension to June 23 has been requested to get the I
sewer service in at 1890 Eagle Drive. There has been no word recently from Louis
Simcask, 3040 Rawson Street, so the City Attorney was asked to file suit against
that property owner, as well as to serve another warrant on Fred Blair if the
sewer work is not done on his properties immediately.
It was noted that one bid was received in response to the Invitation to Bid on a
new garbage truck. After the figures were reviewed, Councilman Lee moved
to accept the bid of Star line Equipment Company, Boise, Idaho, for a new gar-
bage -collection bed mounted on a Ford F -7 50 Truck, with specifications as listed,
for $22,800 as stated on the quotation, f. o. b. 'Ammon, 60 days. The motion was
seconded by Councilman Swensen; voting was all in favor; motion carried. Attorney
Smith advised that the City could call and give verbal notice that the bid was
accepted then send a written notice and ask for clarification of terms such as
delivery date and manner of payment.
Bonneville Council of Governments - Councilman Swensen reported that further
discussion was held on the a.dvantages of the local government units forming an
Economic Development District at the BCOG meeting that morning, and Mayor
Wehmann noted that he was in attendance also and was impressed with the in-
formation given. It was pointed out that members can withdraw after one year
if they so desire. The Council members were in agreement that the feeli ng of
the City of Ammon as being favorable toward joining said organization should be I
made known at the next meeting on the subject on June 15 and that an official
decision can be made at the Council Meeting on June 16.
City Attorney - Nothing to report.
City Engineer - Regarding an estimate of the cost of leveling the land on the
property purchased for a City park in the Peterson Park subdivision, Engineer
Benton presented a figure of $2700 to $3000 to do the entire job of moving approxi-
mately 2700 yards of dirt. He suggested t hat, if funds are -not available for all of
the leveling as indicated, the City could designate certain parts of the park to be
planted at this time under the seeding project for which the L. D. S. Church proposes
to furnish the labor as a Bicentennial Activity.
Fiscal Operations - Mayor Wehmann distributed copies of the worksheet for the
Revenue Sharing Planned Use Report which must be sent in by June 23, and re-
quested that each Council member be prepared with proposals for the use of
this year I s Revenue Sharing funds so -that action can be taken at the next meeting on
June 16.
In other matters, it was indicated that the Lions Club members have not done the
wiring at the McCowin Park shelter yet, and that the Library Committee members
are doing well in getting some plans started.
