Councilman ,Swensen moved that the Mayor be authorized to represent the City at the IPUC hearing in regard to the rate increase requested by Utah Power and Light Company and go on record as opposing.it and express the concern of the City and the citizens. The motion was seconded by Councilman Anderson; . voting was unanimous in favor; motion carried. Claims were approved for payment. The meeting was adjourned at 11:.05 P. M. Wehmann Councilman Russell N. Swensen Councilman Marvin J. Anderson Councilman Francis Lee Councilwoman Carol A. Dille P. M. by Mayor George Wehmann with Deputy Clerk Marian Perrenoud Attorney W. Joe Anderson Engineer David E. Benton Maintenance Supervisor LaVern E. Williams Others present were David M. Hudson, Ann H. Schnur, Fred J. Hahn, Dick McDonald, Craig Mowrey, Gene Simpson, Ron Nelson, and Clyde Johnson. Councilman Anderson conducted a pledge of allegiance to the flag. Prayer was offered by Councilman Russell N. Swensen. Councilwoman Carol Dille. stated a correction of the January 21, 1976, minutes should read that five signatures did not represent 75% of the neighbors in the David Hudson applicat~;; a non-commercial kennel license. With that correction the minutes will stand .approved. Councilwoman Dille said there must be at least six signatures on the application and two neighbors are out of the State for the winter. Permission for a ninety-day temporary permit was asked for' by David Hudson, 3385 Owen St. Councilwoman Carol Dille said she would locate the addresses of Mildred Empey and Evelyn Thurman who are out of the State. Councilman Swensen moved to issue a temporary permit of ninety-days to David Hudson, 3385 Owen St..>; for a non-commercial kennel license. Council-. woman Dille seconded it. Voting was all in favor; motion carried. Councilwoman Carol Dille said there were 75% of the signatures needed by Roy Chapman, 2980 Teton St., for a non-commercial kennerlicense. Council- woman moved to approve Roy Chapman of 2980 Teton St. a non-commercial kennel license. Councilman Russell Swensen seconded it., Voting was all in favor; motion carried. In regard to Ordinance #136, Dick McDonald and Attorney Fred Hahn represented Tele-Cable Company with Attorney Fred Hahn to be the spokesman. He explained that at the time Cable Television Co. applied with the City of Ammon for its franchise the F. C. C. didn't authorize subscription pay television, but they do now. This program is being developed in many areas. The copy attached hereto is the Ammendment to Ordinance #136. Dick McDonald explained, 'iOnly those who are on Cable TV and who subscribe to the pay TV may have additional programs such as first run movies, concerts, etc." The cost is running between $8.00 to $15.00. . They said they would have to come back witlh the rate structure of the programs. Ordinance #136 has had one pre and one post reading before it is published. Councilwoman Dille moved that the first two readings of Ordinance #136 be waived. Councilman Swensen seconded it. Voting was all in favor; motion carried. Councilman Swensen moved to have Ordinance #136 have a third reading. Attorney Anderson read the ordinance. ,Councilman Swensen moved to adopt Ordinance #136. Francis Lee seconded it. Voting was all in 162 favor; motion carried. Ordinance #136 passed on the third reading. Ron Nelson represented several bbys ~ho would like to ha.ve a hockey team, but have no place to_ practice. He requested permission to use the water hydrant and 150 feet of hose to flood the N. W. corner of Brookfield Lane and Ross Ave. Mayor Wehmann suggested LaVern Williams to be. there to acquaint them how to use the valve and see that it is sprayed correctly. Nelson agreed to this. Also, Nelson rea~ized there would be no discrimination as to who would use the pond.: Councilman Anderson moved the. petition' be granted. CouncilmanSwensen seconded it. Voting was all in favor; motion carried. Clyde Johnson, representing Utah Power and Light Co., said the iterim rate of 15% was granted. They have applied for a 33% potential rate increase and it could go as high as 69%. Utah Power and Light Co. cancelled out the lights for Avocet ~ Curlew and Sabin on 17th St. He said when they install high pressure sodium lights they have to set up more poles. He said there are 104 sodium lights in Ammon. Also, he said they will start tillling the City one month in advance. He stated from October 29, 1975, to February 29, 1976, the:re is a back bill of $2,756.00. Attorney Joe Anderson questioned the mistake made by Utah Power & Light Co. City Engineer David Benton will send three (3) 30"x36" city maps to Utah Power & Light Co. so they can show the exact location of the street 'lights. One: copy each for Utah Power & Light Co. , Ammon City Council, and City Engineer David Benton. Mr. Johnson said Utah Power and Light Company pays ten times as much for cross-arms as they used to .be and with an increase of population they have to plan ahead for ten years. MayorWehmann pointed out that the service rendered and public relations has been nil, (i. e. ) 1. NJthing has been presented about the rate in- crease to the public. 2. Discussion for lights on 17th Street--we are highly desirous to-have the lights put in the-reo If it- can't be done, someone has to tell us. Mr. Johnson replied: "Three years ago he was told he was not in a selling position, but it's bad that Utah Power and Light Company have not had closer touch with City Councils,etc. Mayor Wehmann stated there will have been three (3) rate increases within two years with no notification to the public other than showing the increase on the power bill. They should institute a more positive plan than what we have been given. Also, he read a letter from the City Clerk of complaints of broken lights and getting them replaced. Mr. Johnson replied, "that is one of their bi-ggest problems. They have had to replace as many as 28 lights in -one night. 11 He asked that we note the dates they were broken and then how long it takes to replace the lights. It was noted by LaVern Williams that there are six wells, foul' being used, two lift stations and three storm sewers. In regards to Committee Reports, Mayor Wehmann suggested each one be given in turn and then .rotate each month. Fiscal Operations. Councilman Russell Swensen reported an investment of $45, boo. 00 in the Bank of Commerce for ninety-two days at 5. 470/linterest. Councilman Swensen said his committee met-last week and will again Friday, February 6, 1976, -of this week. They determined a bulk permit fee for the newsletter is $15..00, calendar year fee is $40. 00, and piece -goods fee is 7.7 cents each. Councilman Swensen thought the coupon -payment booklet was a good idea. Councilman Swensen noted a maintenance employee would be ter- minated February 13, 1976. I I Parks and Recreation. A proposal to have grass and an above ground sprinkler I system around the pump house at well #6 was introduced- by Councilman Francis Lee. Public works to include the cost of the sprinklers etc., in their budget. The cost of the grass is part of the Sewer ~ontract. Police and Fire Department. Councilwoman Carol Dille went to the Sheriff for his signature and to check over the Law Enforcement Contract. - There were points he didn"t approve of so it was revised. He had not seen pre- vious contracts with the County. It was corrected to eliminate the She:riff' s concern. The Compensation reads: The City shall pay to the County as com- pensation for the services to be herein rendered for the term as stated the sum of $32,804.00. Councilwoman Dille moved we accept the amended con- tract with the Bonneville County Sheriff's Department. Councilwoman Dille said she would have to check with the Fire Insurance Co. to see if the City has liability on that truck. Council- woman Dille said City of I. F. changed the controls on the dogs to $3.00 for male and $5.00 for female dog licenses. She recommended that we leave ours the way it is. Councilwoman Dille proposed a $1. 00 fee fine if dog licenses have not.been obtained by January 31. After discussion this was withdrawn for further study. Public Works. Councilman Francis Lee contacted all except four on his list ~ have their sewers hooked up. All gave definite commitment by March 31, 1976. Councilman Lee moved to have legal action taken against Fred Blair relative to hlS 1allure to comply wlth the sewer ord.lnance. He has been sent letters and a reglstered. :letter wlth no response. CounCllman Swensen seconded it. Voting was all in favor, motion carried. Councilman Lee received three bids from Mr. Campbell, Mr. Zundell, and Mr. Wolfe, for re.moval of four trees and five stumps from Ammon-Lincoln Road. Councilman Lee stated Mr1 J. D. Wolfe would remove the four trees at $290.00, and the five stumps at- $100.00 and take out another tree at no price. Total being $390.00. Councilman Lee moved that J. D. -Wolfe remove the five trees and five stumps. Councilman Swensen seconded -it. Voting was all in favor, motion carried. Councilman Lee asked Councilwoman Dille to ask the Sheriffs Dept. about street signs and also the street lights- that are out. Councilwoman Dille received a request to pave the other half of Midway. Councilman Swensen said half is owned by the Ammon Jr. High School and the other half by the City. The School does not want to pave it at this time. Councilman Swensen asked if the City would be replacing the garbage truck. Councilman Lee said he has an unofficial estimate of a truck from Smith Chevrolet and a bid for a 20 yard bed. Bonneville Council of Governments Councilman Swensen stated that Ammon City's assessment will be slightly less than $1492.41. Councilman Swensen stated there were letters signed and sent to House of Representatives in Boise on House Bill 420 Jan. 20, 1976." House Bill 422 Ammended Section. House Bill 418 Irrigation District. Councilman Swensen read bill #418. Mayor Wehmann stated that he wanted to be sure that potential conflict of interest were identified to him as soon as was possible. Old fusiness yet. On the Roland T. Romrell easement. He hadn't been contacted The bid for a drain to be installed at Geneva & Vaughn St. was set at $1500.00. EPA approved proposed revision sewer ordinance with only minor changes. EPA will begin processing funds due the City. Engineer David Benton reported that the OffiCial City Map has been updated. Each of the following have a copy of the Sewer Maintenance Manu~ls. Wayne Wolfe, Ammon City, and City Engineer David Benton. A letter was being requested from City of 1. F. indicating they are satisfied with the drawings, specifications and manuels they have recieved. Mayor Wehmann stated the City of Ammons portion for the 17th St. improvement for the bridge and asphalt is $28, 905.12. This is in addition to the amount already paid the State. Lewis Nielsen 3217 E. 17th St owes $91. 00 to Ammon City. Mr. Benton talked with him and his problems were with the County. Mr. Nielsen promised to pay the City. The rates are. 1306 per 1000 gallon and to be increased to . 2665 per 1000 gallon. Attorney Joe Anderson read the second reading of Ordinance #137. There will be a final reading on February 18, 1976. Funds' will be here in three weeks when Idaho Falls sets their rates. Mayor' Wehmann noted a resolution should be reviewed annually and updated periodically. Street Fund Certification - Mayor Wehmann said the total revenue is $164, 035. 55, the total expenditures is 160, 990. 34. The unexpended balance is $3,045. 2l. Certification to this effect has been sent to the State Auditor with a copy to the Post Register for publishing. Establish budget time schedule - Mayor Wehmann proposed a budget work s,ession I with the Council and committees to be set up 'February 11, 1976, at 7:30 P. M. Attorney Joe Anderson said there is to be two publications 15 days before the hearing and seven days apart. Mayor Wehmann noted a finali:;:;ed budget will be required by. the 3.rd of March with the public hearing scheduled for 7: 30 P. M. on March 17, ,1976. Mayor Wehmann said the unofficial population of Ammon is 3,630, a 42. Q% Jncrease in the last five years. This. will effect the Highway tax and liquor funds. Since 1970 there has been an agreement that Jim D. Steel receive $400.00 from the City of Ammon for flood control. Now that the Ririe Dam is about completed, Councilman Lee made the recommendation to have the Mayor inform Mr. Steel he may not be paid for this year. Mayor Wehmann said he would talk first to Civil Defense Director Thomas J. Wadsworth and Vance Barnett of the flood control district. Mayor Wehmann asked the Council to come fifteen (15) minutes early to sign claims at the regular council meetings. , Councilwoman Carol Dille moved the meeting be adjourned., Councilman Swensen seconded it. Mrs. William (Kathy) Quapp appeared before the City Council to express her concern about the dog problem in her area. Mrs. Quapp lives in Jennie Jean Estates. Since she gets water through the City of Ammon and since she purchased an Ammon dog license, she wondered if she shouldn't register her complaints to
