Swensen with the following City Officials present: Mayor Russell N. Swensen Councilwoman Carol A. Dille Councilman Robert D. Williamson Councilman Merle J. Quigley Councilman Thayle D. Monson Others present during the meeting were Orin Searle, Horace and Theone Smith, and Sharel Judy. The pledge of allegiance to the flag was directed by Councilwoman Dille and the invoca- tion was given by Mayor Swensen. In response to an inquiry presented by Orin Searle of 3055 Teton Street regarding the possibility of purchasing a portion of City land to the north of his property on which to construct a garage for his recreational vehicles, it was agreed that he should meet with the City Engineer to see if some recommendations could be made to meet Mr. Searle's needs without involving City property. Theone Smith of 2150 Ammon Road said that, according to information received from her attorney regarding the McQuillen log house case, the court will be issuing an order to have the building moved. She asked if the City could give notice on the date that the house must be moved since she understood that the court order does not mention a time City Clerk Deon Hemingway Public Works Director Hayse Engineer David E. Benton Attorney W. Joe Anderson L. Whiteley June 6, 1985 June 20, 1985 296 limit. Attorney Anderson advised that the City Council could take action to require the owner to have the house taken away. It was moved by Councilman Quigley and seconded by Councilwoman Dille that, upon receipt of the judge's decision on the McQuillen case, if it is in favor of the City, that Mr. McQuillen be given ten days from the date of the order to have the log home moved; voting was all in favor; motion carried. The matter of the claim filed against the City by the Smiths for a portion of their legal expenses incurred while they have been involved in the problem of the location of the log house was discussed. It was pointed out that the claim has been denied by the City's insurance carrier because it was not filed within the time allowed by state statute, but Attorney Anderson stated that the Smiths can submit again if they have additional information to be considered. In accordance with a recommendation in a report from the Planning and Zoning Commission, I. a motion was made by Councilwoman Dille and seconded by Councilman Monson to extend the Special Use Permit for storage graineries on the property owned by Judys' Ida-Mon Ranches at 3070 Sunnyside Road. Approval was indicated on a request for a tennis-court dance on July 4 which was mentioned by Councilman Quigley. With reference to the bid opening on May 23, 1985, for the purchase of a used fire truck, Councilman Williamson informed the Mayor and other Council menbers that further action is needed since the truck for which the bid had been accepted was already sold. A list of other used fire trucks which were available from a company in VanBuren, Arkansas, was reviewed and terms for a purchase if approved were mentioned. Council- man Williamson moved that the City purchase a 1966 GMC fire truck for the quoted price of $21,375 and that a check for $500 as down payment be sent to Wilson Fire Apparatus, Inc., in VanBuren, Arkansas. City Clerk Deon Hemingway Public Works Director Hayse Attorney W. Joe Anderson Engineer David E. Benton Dille L. Mayor Swensen announced that the notice of public hearing had been published and written notices sent to neighboring property owners. He also reviewed the requirements of the law for conducting public hearings. Loren Peterson and Shirley Dawson were sworn in to give testimony. It was noted that the application requested a variance of 2t feet to be allowed to build an attached garage with a sideyard of 5 feet at the front corner on a lot that is narrower in front than in the back so that the front of the garage would be even with the front of the existing house. Mrs. Dawson expressed concern about the distance that would be left between the houses, and Mr. Peterson pointed out that there would still be 17 feet since the side of Dawson's house is 12 feet from the property line. In response to a question by Councilman Monson, Mr. Peterson explained that the zoning require- ment of 7t feet of sideyard could be met if the proposed garage were moved back about 4 feet but he would like to get a variance for aesthetic reasons, as mentioned in the
