Council Minutes 08/04/1983 I ~ to "- () <C c::( I I July 21, 1983 August 4, 1983 241 Mayor Wehmann expressed concern about having anything happen to the cement pipe in Falcon Park since it 'Was placed there for playground equipment as a Boy Scout project, and he said he 'Would talk to LaVaun Merrill, 'Who represents the property o'Wners. It 'Was men- tioned that the City has a 'Waterline and sprinkler system in the park under an agreement of several years ago and that an offer to sell the land to the City for $10,000 is no'W' being made by the o'Wners, according to Mr. Merrill. In his report, Councilman Williamson explained that several responses 'Were received, but none 'Were positive, on the requests for proposals to develop two of the hydroelectric projects for 'Which the City has preliminary permits. In relation to the animal control work, Councilman Williamson asked to be given a copy of all complaints about dog problems. Engineer Benton referred to a letter from Eric Ste'Wart of the State Health Department and a contact 'Which has been made 'With Ernest Martin about problems 'With the settling pond that 'Was used in the past for a potato processing plant, and Mayor Wehmann indicated that he 'Would 'Write to Mr. Martin. Information brought to the attention of the Mayor and Council by Public Works Director, Hayse, Whiteley, was concerned 'With weed removal and cleaning of dumpsters and sump pumps. Permission 'Was indicated for Mr. Whiteley to travel to Boise to check on equipment 'Which the City needs that is available as Federal surplus property. Mayor Wehmann stated that he intended to send a reply to Gail Le'Wis of the State Parks and Recreation Department regarding her comments about the tennis court lights in a letter received from her recently. Claims to pay were approved in the amount of $ J4, 035.97, along 'With vouchers totaling $19,978.95 for payroll and related expenses paid since the previous meeting. Swensen at 7:30 P.M. with the following City Officials present: Attorney W. Joe Anderson Acting Mayor Russell N. Swensen City Clerk Deon Hemingway Councilman Robert D. Williamson Public Works Director Hayse L. Whiteley Councilman Thayle D. Monson Engineer David E. Benton Absent: Mayor George Wehmann Councilwoman Carol A. Dille Also present during the meeting were Larry and Beverly Boyle and their son of 3750 Marlene Street. The pledge of allegiance to the flag was conducted by Councilman Williamson and the in- vocation was offered by Councilman Monson. Minutes of the meeting on July 7, 1983, were approved as prepared. The meeting was opened as a public hearing on the proposed uses of General Revenue Sharing Funds in the Fiscal Year 1984 budget, with notice having been published in the newBpaper as required by law. The amount of funds available was listed as $43,080, including an unexpended balance of $20,180 and estimated revenue of $22,900. There 'Were no citizens present to make comment and no 'Written input had been received. Suggested expenditures as itemized in the tentative budget were revie'W'ed. The Council members expressed agree- ment 'With the use of the money as designated and called attention to an amount proposed for support of the Community and Rural Transportation (CART) program. The hearing was declared to be closed. The next item of business was a public hearing, as advertised, on a request for a variance submitted by Larry and Beyerly Boyle of 3750 Marlene Street. The application and accompanying drawing w'ere considered in connection with the City zoning, 'Which re- quires 20 feet of sideyard for accessory buildings in RP Zones. It 'Was noted that the Boyles desired to construct a storage building 'With 10 feet of setback because of exist- ing improvements on the lot. Councilman Monson stated that he had been to the property and looked at the proposed building site. A motion 'Was made by Councilman Williamson and seconded by Councilman Monson to approve a variance of 10 feet for 3750 Marlene Street to allow a storage building to be constructed 'Within 10 feet of the property line. Having observed that it 'Was not yet 8 P.M., the time for 'Which the hearing August 4, 198] 242 w'as advertised, it was moved by Councilman Monson and seconded by Councilmam Williamson, with voting all in favor, that the public hearing be recessed. When the hearing was re-opened at the appropriate time, it was made a matter of record th~t none of the ad- joining property owners who had been sent written notice, or any other citizens,w'ere present to make comment. Voting on the previous motion to approve the variance w'as Williamson yes, Monson yes, Swensen yes; motion carried and variance granted. The public hearing was closed. Councilman Monson made reference to a model ordinance on manufactured housing which was studied by the Planning and Zoning Commission several months ago. It was agreed that action on this matter should not be necessary in view' of a recent court decision which upheld zoning ordinances that restrict the placement of mobile homes to mobile home courts, mobile home parks, or mobile home subdivisions. Councilman Williamson reported that there is a need for more volunteers on the Fire Department. Matters concerning public works which were mentioned by Hayse Whiteley included cleaning of dumpsters, the schedule for closing the swimming pool, and items purchased from surplus property during his recent authorized trip for this purpose. According to Engineer Benton, the form for Certification of Elevation for construction on floodplain building sites, which w'as referred to him for recommendation, is satis- factory to be adopted as a requirement by the City for showing compliance with the floodplain management ordinance. A workshop meeting in connection with the proEosed budget for Fiscal Year 1984 was scheduled for 8 P.M. on Tuesday, August 1 . Claims to pay totaling $10,640.10 w'ere presented and approved, along with vouchers for payroll and related expenses paid since the previous meeting in the amount of $14,396.48. Monson Others present during the meeting were Pam Dixon, 3615 Vaughn St., Marsha Hackman, 3635 Vaughn St., and Dick Bybee, 21]0 Ross Avenue. The pledge of allegiance to the flag was directed by Councilwoman Dille and the invoca- tion was given by Mayor Wehmann. Minutes of the meeting on July 21, 1983, were approved as prepared. I City Clerk Deon Hemingway Public Works Director Hayse L. Whiteley Engineer David E. Benton Planning Commission Member Kathy Dansie Pam Dixon and Marsha Hackman expressed concern about the speed of the traffic on Vaughn Street considering the number of little children on that street, and requested that the Ci ty install a speed bump or a 15 mile-per-hour sign. Mayor Wehmann explained that bumps on the streets are not allowed because of the safety factor involved for emergency vehicles, and it was the opinion of the Council members that a change in the posted speed limit would not gain anything. Other ways to help with the problem W'.ere mentioned'l such as a one-way street or a "Caution--Children" sign, and it was agreed that it might be advisable to look into these possibilities. The traffic hazard created by trees on the yard at the corner of Geneva Drive and Vaughn Street was also brought to the atten~ ~ of the City. Dick Bybee, 2130 Ross Avenue, appeared to discuss the decision which was made at the meeting on July 21, 1983, about the repair of the portion of his cement driveway that is in the City right-of-way and which was damaged when a broken waterline was being fixed earlier in the year. In response to Mr. Bybee's inquiry about the City's obliga- tion to do more than replace the damaged area with asphalt or remove the section of concrete and fill in W'ith gravel, Mayor Wehmann explained that the City's proposal was based on a shortage of funds. Comments by the Council members indicated that there had been nothing different presented to cause them to change the original decision. Mr. Bybee mentioned that there are some sunken places on his yard which he felt are the result of the water being alloW'ed to continue running in the main for several hours after, the leak was discovered on a weekend.
