Council Minutes 03/03/1983 March .3, 198.3 232 CITY OF AMMON Jvlarc h .3, 198.3 Minutes of the Regular Meeting of the Mayor and City Council: The meeting waS called to order at 7:30 P.M. by Acting Mayor Russell N. Sw'ensen with the following City Officials present: Acting Mayor Russell N. Swensen Councilman Robert D. Williamson Councilwoman Carol A. Dille Councilman Thayle D. Monson The pledge of allegiance to the flag was conducted by Councilman Monson and prayer w'as offered by Councilman Williamson. City Clerk Deon Hemingway Attorney W. Joe Anderson Engineer David E. Benton Public Works Foreman Thomas Reese Also present were Scout Leader Bruce Reiche, 2475 Rimrock Dr., and Scouts .Jason Coles, Jim Terry, David Reiche, Quinn Simmons, Mark Austin, Ryan Pierson, and Brad Bohn. Minutes of the meetings on December 2, 1982, December 16, 1982, January 6, 1983, and January 20, 1983, were approved by motion of Councilw'oman Dille, seconded by Councilman Williamson, with voting all in favor. An application for a sideyard variance submitted by E. Ray Leeman of .3735 Samuel Street was considered. It was noted that there was an inconsistency between the narrative of the application and the attached drawing regarding the exact location of the property line in relation to an existing fence, which made the necessity of a variance appear questionable. Councilman Williamson moved to hold action on the variance request pend- ing the applicant's investigation of the property line location to determine whether or not a variance is needed. The motion was seconded by Councilman Monson; voting was all in favor; motion carried. The Council members deliberated on a claim filed by Evelyn (Robison) Thurman for one- half of the attorney fees to correct the legal description on a deed, as mentioned in the Council Meeting on November 18, 1982. Attorney Anderson advised that his office could have prepared the Correction Quit Claim Deed if it had been requested, and he felt that the City has no obligation in the payment of the fee charged by Mrs. Thurman's attorney. It was moved by Councilman Williamson and seconded by Councilman Monson that, based on the advice of the City's legal counsel, the payment of the claim be refused. Voting on the motion was all in favor; motion carried. indicated that tabled until by Councilman Concerning a model ordinance for manufactured housing, agreement was more time was needed for evaluation, so discussion on the matter was the next meeting in a motion made by Councilw'oman Dille and seconded Williamson, with voting all in favor. Councilwoman Dille mentioned plans for ordering trees and shrubs from the Soil Conserva- tion Distruct and review'ed the recommendations made by Landscape Architect David Weaver regarding which plants w'ould be sui table for the parks from the list of those available. According to Attorney Anderson, a petition for the City to be an intervenor in the current utah Pow'er & Light Company rate-increase case has been filed wi th the Idaho Public utilities Commission, and the pre-hearing conference has been held. He noted that the percentage of increase being requested in the case figures at about 10%. Engineer Benton recommended that a French drain be put in to help solve the drainage problem at Wanda Street and Princess Drive, and stated that he intends to check with the City Public Works Foreman about the City doing the w'ork instead of having it con- tracted out. Acting Mayor Swensen called attention to the flood alert that was in effect for that area on the previous night, which did not develop into a problem even though there was a lot of water there from the snow' melting quickly. Information was presented by Public Works Foreman Tom Reese about the progress on several projects such as moving and replacing traffic signs to meet the standards of the Uniform Sign Code and working on the shop ceiling and insulation job. Claims totaling $27,135.63 were presented by the City Clerk along with vouchers in the amount of $4,317 .49 for payroll expenditures, etc., paid since the last meeting, all of which were approved. A motion to adjourn was made voting was all in favor; the by Councilwoman Dille and seconded by Councilman Monson; meeting waS adjourned at 8:30 P.M.
