Council Minutes 07/03/1980 I ~ CD I"' U <( <:[ I I June .5, 1980 145 The matter of lights for night swimming at the pool was discussed at length, and it was decided that the pool manager should determine if lights are required for safety and, if needed, Councilman Monson, as the expert, is to advise if it will be best to replace the underwater lights or install the new overhead lights which are on hand; consequently, it was moved by Councilman Rowberry and seconded by Councilman Monson that the Council reconsider the decision made at the last Council meeting to install overhead lights at the swimming pool; voting was Rowberry yes, Monson yes, Dille no, Swensen no; tie vote; Mayor Wehmann voted yes; motion carried. Hayse Whiteley, Public Works Director, acquainted the Mayor and Council with special work items and recent purchases for repair of equipment. Attorney Anderson recommended Blair Grover of Rigby as legal counsel for the suit against H-K Contractors regarding sewer leaks, and approval was indicated. Reference was made to a seminar on water system Co back-flow prevention which is to be held in Pocatello. It was noted that there will be no regular meeting on June 19 because of the AIC Con- ference on that date. Mayor Wehmann asked that Council members have preliminary FY-8l budget figures ready by July 1. Claims in the amount of $16,796.11 were approved for payment. It was moved by Council- woman Dille and seconded by Councilman Swensen that the meeting adjourn; voting was all in 'favor; meeting adjourned. CITY OF AMMON July 3, 1980 Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7:35 P.M. by Mayor George Wehmann, with the following City Officials present: Mayor George Wehmann Councilman Russell N. Swensen Councilwoman Carol A. Dille Councilman David Rowberry Absent: Councilman Thayle D. Monson The pledge of allegiance to the flag was conducted by Councilman Rowberry and the invoca- tion was offered by Councilman Swensen. With reference to the complaint made at the previous meeting regarding littering at 2045 Dove Drive, Mayor Wehmann and Councilman Rowberry reported having looked at the yard at that address and found that the problem had been corrected. The Warren Bird Glaim, which was brought up for consideration at the June 5th meeting, was discussed again without decision since the existence and removal of a culvert as claimed by Mr. Bird had not yet been researched and verified. A bid on the 1970 Plymouth Fury pOlice/fire car, which has been declared surplus, was opened and read, and it was agreed that the bid for $20 from Delbert Colby was too low. Councilman Swensen moved that said bid be rejected and the motion was seconded by Council- woman Dille; voting was all in favor; motion carried. Instructions were given to re- advertise to accept bids on the surplus vehicle. Mayor Wehmann reported that the City office was burglarized recently, with a loss of approximately $64 in coin and currency, and the lock on one door was ruined. Regarding the City's efforts to get the Ammon Produce Com~any hooked on to the sewer system, Mayor Wehmann reported that a meeting was held with the owner, Ernest Martin, who requested plans and information on costs so he can determine how to take care of the matter. Engineer Benton agreed to check with the City of Idaho ~lls on the requirements for holding tanks for industrial waste and to prepare a sketch of suggested settling pond plans. Benton In response to an inquiry by Mayor Wehmann, Attorney Anderson explained that the City has not been granted a judgment against Eastgate Mobile Vill~e on the delinquent account so is not in a very good position to receive any money. Mayor Wehmann indicated that he would write a letter to the new owner of the trailer court and ask for what help can be given in collecting the approximately $5,600 due. It was mentioned that plans for Ammon Day on July 12th are going ahead. Councilwoman Dille announced that the BOR Grant for park improvements has been extended until June, 1981, and that word has been received that two railroad cars, painted tree green, will be coming from Union Pacific in the near future to be placed in the parks for equipment storage purposes. It was pointed out that the new overhead lights have been installed at the swimming pool on the poles that were already there, and the manager re- ports that the lighting provided makes it possible to see to the bottom of the pool with no problem. July 3, 1980 146 Councilman Rowberry informed the Mayor and Council that he was told that Chris Humphries, 2830 Ross Cirlce, is operating a shelter home for handicapped people. It was noted that Mayor Wehmann and the Building Inspector were already aware of this matter and have learned, through the City Attorney and the State Health Department, that State law gives authority for such use of homes in residential zones without local ordinances being involved. Accordingly, Mr. Humphries has requested a fire inspection and a building inspection, and Mayor Wehmann indicated that he would write a letter to advise the home owner of building code safety requirements. In response to an idea proposed by Councilman Rowberry that a citizen cOffi@itt8e be formed to investigate the options available for providing power in Ammon by some means other than Utah Power & Light Company, Mayor Wehmann explained that the State law would have to be changed and that lobbying by the power companies has pre- vented this from happening. It was mentioned that the application for hydro-electric I rights at \he Ririe Dam has never been finalized by the City. Announcement was made that Attorney Blair Grover of Rigby has agreed to represent the City in filing suit against H-K Contractors regarding leaks in the sewer system and that information is being obtained to identify the location of major leaks by the use of City of Idaho Falls camera equipment. A report on the status of properties where owners have been given notice to remove junk cars indicated that Dewey Miller, 3880 Ross Avenue, is making satisfactory progFess in cleaning up his yard, but the situation at the residence of Carol Kranz, 2675 Salmon St., is still bad and needs some follow up. Engineer Benton reported on the progress of the construction on the E-Z Storage project along the east side of Sand Creek, noting that the Irrigation Company has given approval on the bridge and the location of the fence along the creek and that the construction of the chain-link" fence all around the property will start soon, with an emergency gate at the south end and a gate at the north for access to the City storm sewer pump station, and the fence adjoining the residential lots along Falcon Drive is planned to be two feet in- side the storage project property line. It was mentioned that an eight-inch waterline has been put in from the main on Falcon Drive to the first fire hydrant and a six-inch line from there, and that the sewer main already runs through the property and the plan is to stub in a sewer service for a sanitary dump station and flushing of trailers that are brought for storing. Mayor Wehmann informed the Council that a letter instructing Engineer Benton to proceed with the annual inspection of the bridge across Sand Creek at 17th Street has been sent. I Public Works Director, Hayse Whiteley, asked fer thefe~ling of the Mayor and Council re- garding a proposal from the County to trade the work of the City doing street sweeping in the County subdivision of Lawndale in exchange for the County doing the striping on 17th Street, with approval being indicated after costs were discussed and Mayor Wehmann stating that he would check to see which government unit is responsible for striping 17th Street considering the joint effort of the County, City, etc., which went into the pro- ject of widening that street. Mr. Whiteley also reviewed matters pertaining to the summer- youth and regular CETA employees, measures taken to improve the security in the shop area of the City Building, vehicles on the Stedtfeld pro~erty on Aspen Lane, and street-patching work. The City Clerk presented claims in the amount of $20,295.89, which were approved for pay- ment. It was moved by Councilman Swensen and seconded by Councilwoman Dille that the meeting adjourn; voting was all in favor; meeting adjourned at 9:45 P.M.
