U <( <[ I I April 17, 1980 CITY OF AMMON April 17, 1980 l;ln Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7:45 P.M. by Mayor George Wehmann with the following City Officials present: Mayor George Wehmann Councilwoman Carol A. Dille Councilman Thayle Monson Councilman David Rowberry Absent: Councilman Russell N. Others present during the meeting were Deputy Clerk Aleen C. Jensen Engineer David E. Benton Attorney W. Joe Anderson Public Works Director Hayse L. Whiteley Swensen June Wehmann and Leland Dille. The pledge of allegiance to the flag was conducted by Councilman Monson and the invoca- tion was offered by Councilman Rowberry. In response to an inquiry which has been received by the City Clerk, the City Attorney's advice was requested regarding depositing public funds as regulated by State statute, and Attorney Anderson expressed the opinion that the City of Ammon funds need not be "spread" in several different banks since there are)lO banks insidJff; the City Limits. It was mentioned that there will probably be a bank in Ammon some time in the next few years. Mayor Wehmann handed out information on electrical costs for pumping water in the summ~r watering season, and pointed out that, since Utah Power & Light Company was recently granted a rate increase of 21.6%, the present charge for water will not bring in enough revenue to pay the power bills during the next few months if the regular watering schedule is used. He proposed that the City either change the watering cycle to four days or in- crease the water rate by adding on an extra charge for the summer months or a small year-round increase. It was decided that some newspaper publicity should be put out on these proposals and input from the residents requested so that a decision can be made which is responsive to the desires of the citizens. The opinion of the Council members was requested by Mayor Wehmann regarding the payment of fees in connection with a building permit for Kenneth A. Damm to build a house at 2945 Western Avenue. It was agreed that it would be satisfactory in this case and when requested in the future, as a policy of the City, to collect only the building permit fee prior to the starting of construction, then the connection fees and other costs related to hooking up the water and sewer services must be paid before the connections are made to the service lines. It was recommended by Councilwoman Dille, with Council approval being given, that Evan Thomas be employed as Swimming Pool Manager for the 1980 season at a salary of $3,200 for the season, and that Kate Anderson be hired as Assistant Pool Manager and Lesson Supervisor. A suggestion was made that the late night swimming sessions be curtailed this year to help cut back on pool expenses. Councilwoman Dille mentioned that there is still a need for a Chairman for Ammon Day. The matter of $30,000 still being available in the BOR Grant for park improvements and the City's lack of matching funds was brought up for consideration, and Mayor Wehmann indicated that he would make an appeal in the newspaper for the help of interested citizens in the planting of trees and shrubs, in- stallation of playground equipment, and other in-kind services. Councilman Monson pointed out, as he had at the previous meeting, that it would be poss- ible to have the tennis court lights and the swimming pool on the same electricity meter, but no action was taken on this subject. He reported that there are problems with the animal control due to officer disability, etc.. According to Councilman Rowberry, the Planning and Zoning Commission will meet on April 29th to conduct a public hearing on the special use permit for Tiny Tot Day Care Center. A vacancy on the Planning and Zoning Commission was discussed. Adjustments made on the sewer treatment bill from the City of Idaho Falls were reviewed, and it was noted that the account has now been paid in full except for the current month. Attorney Anderson declared "conflict of interest" in the proposed court action against H-K Contractors in connection with sewer construction defects, since a member of the law firm he is associated with is the attorney for H-K Contractors, and he agreed to contact another attorney about acting as legal counsel for the City in this matter. The subject of getting Uniform Tickets printed, as recommended by Attorney Anderson at the previous meeting, was brought up and costs as obtained by the City Clerk were reviewed. In re- sponse to comments by Mayor Wehmann, Attorney Anderson indicated that he would contact the Magistrate Court about paying Ammon for its portion of receipts from fines which were not remitted during 1979 if he is provided with the detailed information, and that he would check on the status of the claim filed by Ammon Plumbing several months ago. Regarding the plans for the water system in Aimee Ann Estates, Engineer Benton agreed to prepare a letter of approval outlining conditions required by the City of Ammon for Mayor Wehmann's signature. It was suggested by Engineer Benton that the City get the necessary signs for the Mountain Valley subdivision and send a bill to the developer. He reported that Robert Nixon still does not have the financing arranged for his storage- unit project near Sand Creek, so the bridge plans are not ready for checking yet. Minutes of the meeting on March 20, 1980, were approved as prepared. According to Mayor Wehmann, there was one response to the notice in the newspaper about the vacancy on the Planning and Zoning Commission, and he recommended the confirmation of the appointment of Robert Williamson, 1915 Sabin Drive, who indicated willingness to serve. It was moved by Councilman Rowberry and seconded by Councilwoman Dille that the City Council confirm the appointment of Robert Williamson to the Ammon Planning and Zoning Commission for a 3-year term to expire on March 1, 1983. Voting was all in favor; motion carried. Recent developments concerning efforts to get the Ammon Produce Company hooked on to the sewer were discussed. It was mentioned that the State Health Department officials have advised that it is the City's responsibility to get this matter taken care of. Attorney Anderson was instructed to write a letter to the property owner, Ernest Martin, to give him notice about the City's requirements for connecting to the sewer as well as the necessity to start using the City water system in accordance with the City ordinances. Mayor Wehmann reported that the claim submitted by Steve Pulley, 2800 Western Avenue, which was mentioned at the previous meeting, will be sent to the City's insurance company. A report concerning the public hearing held before the Planning and Zonimg Commission on April 29, 1980, indicated a recommendation of approval on a Special Use Permit for Tiny Tot Day Care Center at 3415 Molen Street, with an expression of concern about the use of the basement in the operation of the facility because of fire code standards. A public hearing before the City Council was set for 7:00 P.M. on June 5, 1980. Regarding the additional use of water during the summer for outdoor purposes in relation to the increase in power costs for pumping water, Mayor Wehmann and the Council members reported that their contacts with residents during the past several weeks indicated that most people are in favor of paying more for wate~ so they can have the regular yard- watering schedule of every other day. Mayor Wehmann pointed out that, from his cal- culations, the extra charge should be $4.00 per month for the five months of May, June, July, August, and September. After a thorough discussion of the matter, it was moved by Councilwoman Dille and seconded by Councilman Swensen that the City impose a summer- time water fee for single-family residential users of $4.00 per month for May, June, July, August, and September, for a total of $20.00 for the season which can be paid in full with the payment for May services or $4.00 per month. Voting on the motion was all in favor; the motion passed unanimously. Consideration was given to rates for other than single- family, and Councilman Rowberry moved to assess a summer water fee for the months of May, June, July, August,and September, of $1.00 per month per dwelling unit in condominiums, apartment buildings (including 3-plexes and 4-plexes), and trailer parks.
