Council Minutes 02/15/7978 Feb. 15, 1978 24 CITY OF AMMON February 15, 1978 Minutes of a Special (Public Hearing) Meeting of the MaYor and City Council: The meeting was opened at 7:50 P.M. by Council President Russell N. Swensen, with the following City Officials present: Councilman Russell N. Swensen Clerk Deon Hemingway Councilwoman CaroJ A. Dille Asst. Engineer Robert Butler Councilman Francis Lee Asst. Attorney Douglas Nelson Councilman David R. Rowberry Maint. Supervisor LaVern Williams (Mayor Wehmann was excused; enroute from meetings in Boise) I O~hers present during the meeting were Larry Gust, 1920 Sabin Dr., and Elaine McGary, 3255 Meadow Lane.. The first item of business was announced as the mat~er of hearing public comment on the proposed annexation and initial zoning of ~roperty north of 17th Street bordering and including a portion of Sand Creek and described in the legal notice as Parcel 6. Councilman Swensen noted that ~his action was recommended by the Planning and Zoning. Commission after the public hear- ing before that body and is for the purpose of straightening up the City boundary in that location and bringing in property along Sand Creek which was previously omitted. It was determined that there was no one present to make comment on this proposal. Councilman Rowberry moved to annex Parcel 6 with initial zoning of RSC-l (Residential Shopping Center). The motion was seconded by Councilwoman Uille; voting was all in favor; motion carried. The subject of Meadow Lark Estates, Division- NO.2, was brought up for dis- cussion, and was described as property south of 17th Street formerly owned by ~oss McCowin. It was explained that the application of the developer requests annexation and initial zoning of R-l and R-3A. In response to an inquiry by adjacent property owner, Larry Gust, about what is planned on the R-3A portion of the subdivision, Engineer Robert Butler stated that I the developer's intention is for professional building$, but it was pointed out by the ~uncil members that the City would have no control over the construction of multiple family dwellings there if the R-3A zoning is approved. Mr. Gust voiced his objection as a taxpayer to the R-3A Zone because of the possibility that apartments might be built there and high density residential use would add to the problem of the over-crowded school system, etc. He commented that perhaps ~he City should create another zone Tor business buildings without allowing for apartments. Councilman Rowberry moved to recess the hearing on Meadow Lark Estates, Division NO.2, until the March 1, 1978, meeting, 7:30 P.M., in order to make contact with the developer to see what is planned in the R-3A area. The motion was seconded by Councilman Lee; voting was all in favor; motion carried. Councilman Rowberry agreed to follow through with contacting the developer.
