Council Minutes 12/05/1991 I Book 7-401 November 21, 1991 December 05, 1991 to reduce the fire risk and to assure the insurability of his building. Past discus- sions indicate these conditions may be acceptable to the City Council and the Fire Department. Attorney Anderson recommended Skidmore and the City both acknowledge acceptance of these conditions so a certificate of occupancy can be issued. This action would not be taken on the basis of waiving the requirement, but on the basis that at the time the building was built, there was not an enforceable requirement for a sprinkling system. Councilman Anderson commented on the traffic created by Kmart' s grand opening. Residents have requested the City to paint some cross walks on East 17th Street, put up some pedestrian crossing signs, or install some stop lights. The Council recognized the problem, but agreed to monitor the situation and proceed cautiously. Public Works Foreman Rick Williams was asked to contact Rich Hardy of Idaho Traffic Safety about white striping the two traffic lanes on East 17th Street. At the request of Keith and Kevin Roberts, Sanitation Department workers, Councilman Anderson brought up personnel matters as follows: (1) The microwave is locked in the Public Works Office and is not readily accessible to all the employees. (2) They would like to have the opportunity for on-call duty so they can earn extra time. (3) They have worked for the City since 1979 at the same job, and they would like to be considered for other jobs occasionally to spell them off the garbage detail. (4) It is time for a raise. The employees can work out the problem with the microwave. All employees are scheduled for a raise with the pay period ending November 21, 1991. As for the other requests, the employees need to prove capability and responsibility. The annual audit is nearing completion. Galusha plan to review it with Councilman is finalized. Claims were approved. Representatives of Galusha, Higgins, and Crandall and City Clerk Jensen before it Mayor Ard reported on progress of Forsgren and Associates on the reV1S10ns to the design plan for the Ammon Road project. The plans have been sent to the State Transportation Department for their review and approval. Councilman Crandall moved to adj ourn the meeting, and the motion was seconded by Councilman Maeser. Anderson Councilman Harvey Crandall Councilman Ira K. Hall, Jr. Councilman Greg J. Maeser a.t 7:30 P.M. by Council President Greg J. Maeser present: Attorney W. Benton Public Works Director David Wadsworth The Pledge of Allegiance to the flag was directed by Councilman Hall, and the invo- cation was offered by Councilman Anderson. Brian Taylor reported on activities of the Planning and Zoning Commission. (1) A Public Hearing was held December 2, 1991, to consider a request for a Special Use Permit to allow the L.D.S. Seminary to be built in the R-l Zone by the new Hillcrest High School. Following their hearing, the Planning and Zoning Commission recommended to the City Council that the permit be granted. (2) Commission members need up-to-date zoning maps. A goal was set to provide them with maps by December 31, 1991, and the City Clerk was assigned to work with Engineer Benton on the maps. Councilman Crandall suggested the maps be detailed to show City property. (3) Ordinance No. 193 which outlines procedures for conducting Public Hearings was discussed. Regarding Section 1, Paragraph C "at the commencement of the hearing the chairman of hearing shall establish a time limit," it was proposed to change 402 December 5, 1991 "shall" to "may." Attorney Anderson reconnnended rather than amend the ordinance to announce at the beginning of the hearing that the time limit shall be at the discretion of the chairman. Also, the Planning and Zoning Connnission reconnnended elimination of the requirement to swear in those presenting testimony. Attorney Anderson agreed to research this requirement before making a reconnnendation. (4) Councilman Maeser discussed adopting a day care ordinance. The consensus was to leave as is, and day cares do not fit in the home occupation category, but no reconnnendations were made. (5) Changes were reconnnended to the Home Occupation Permit requirements. Councilman Maeser explained their reconnnendations. Most of the changes were minor, and the Council did not have problems with them. However, the Connnission desires mandatory approval of adj acent property owners, and the Council does not agree with such a change because it would give neighbors the right to veto and take away legislative authority of the Council. Councilman Maeser agreed to work with Attorney Anderson to redraft the proposed ordinance to resubmit I to Planning and Zoning for their Public Hearing. (6) The Planning and Zoning Connnission Appreciation Dinner was tentatively scheduled for Tuesday, January 7, 1992, and the place is to be decided. Councilman Hall moved to approve the minutes of City Council Meeting held November 21, 1991, as written. The motion was seconded by Councilman Anderson. Roll call vote: Hall - Yes; Anderson - Yes; Crandall - Yes; Maeser - Yes. The motion carried unanimously. The State Transportation Department sent copies of the plan, proposal, estimate and transmittal letter as submitted by Forsgren Associates for an intermediate design review for the Annnon Road project. They requested the City of Annnon to review this data and to return it with connnents by December 13, 1991. Mayor Ard reviewed the materials prior to the meeting and found no problems. The Council reviewed at the meeting. Councilman Crandall moved to accept the revised plans received from the State Transportation Department for intermediate review and to proceed with the project. The motion was seconded by Councilman Hall. Roll call vote: Crandall- Yes; Hall - Yes; Anderson - Yes; Maeser - Yes. The motion carried unanimously. The City Office was instructed to call the State to advise of the acceptance of the changes. Councilman Maeser read a letter from Forsgren Associates addressed to Clyde Gillespie, Assistant District Engineer, dated December 2, 1991, which reported on the progress of the Ammon Road right-of-way acquisition. I Traffic problems on East Seventeenth Street were discussed. Numerous complaints have been received about the increase in traffic and the difficulty to get out on East Seventeenth Street since Kmart opened. No solution was reached, but it was determined the City needs to make some long range plans to alleviate the problems. Planning ahead should make it possible to come up with necessary funding. Fire Chief Cal Smith reported the fire trucks have been experiencing difficulty getting out on to East Seventeenth. Motorists do not respect the red lights of the emergency vehicles. The Fire Department is checking into a flashing light system for the west bound traffic. They have had no problem with the east bound traffic. The Council agreed to continued awareness of the East Seventeenth Street traffic problem but to wait and see if it settles down after the holidays. Reports: Attorney Anderson reported the Intermountain Construction Tort Claim is still pending by reason of their appeal. They have advised that they will now settle for the 50% offer of settlement originally made by the City of Annnon but rejected originally by Intermountain Construction. Details of the case were discussed, but no action was taken. Attorney Anderson was authorized to negotiate with Intermountain Construction or their legal counsel and report back for City Council consideration. The Public Works Department reported the four way stop has been established at Avocet Drive and Targhee Street. The parking problem by the Mansion House was discussed. There are two problems involved--Mansion House customer parking and INEL I workers' all day parking. Two hour restrictive parking appears to be a good solution, but no action was reconnnended to allow research of the City records to determine parking requirements outlined for Mansion House when their Special Use Permit was granted. Fire Chief Call Smith reported the Fire Department did a walk through at the new Kmart. They discovered a few major violations. The back doors are padlocked during business hours to eliminate warehouse breakins. Another area or concern is battery storage. The Fire Department plans to meet with the manager after January l. Business inspections were completed for Keith Jorgensen's, Servisoft, and Eastgate Drug. Fire safety violations were pointed out. The Council was asked to give direction on how to handle violations. Violators are allowed thirty days to get in compliance. Attorney Anderson advised it is a court determination once a citation is issued. I I I Book 7-403 December 05, 1991 December 19, 1991 The Bonneville County Sheriff's Office called the City of Ammon to advise that customers at Kmart are using the fire lanes to park in. The Fire Department has inherent authority to enforce fire lane parking. Their customers are also abusing the handicapped parking facilities. Enforcement procedures were discussed. Councilman Maeser agreed to seek input from Gil Gardner of the County Prosecutor's Office, and Fire Chief Smith planned to get some input on how the City of Idaho Falls handles. Regarding a Fire Department Appreciation Dinner, members will be contacted to see if they prefer a dinner or a turkey. Councilman Crandall has made an appointment with Galusha, Higgins, and Galusha to review the annual audit. Following this preliminary review, the audit will be presented to the Council at meeting on December 19, 1991. Councilman Maeser asked for direction regarding the law enforcement agreement with Bonneville County. At the present time, Ammon does not have a signed agreement for the 1992 Fiscal Year because of the increase in contract amount which the Sheriff's Office requested. This is a somewhat uncomfortable situation. Attorney Anderson was asked if the City is at risk without a signed contract or if the County is responsible to provide coverage regardless. He responded that Bonneville County has some responsibility, but the amount of coverage is questionable. Discussion included whether or not to try to negotiate a contract, to determine how much coverage the County is required to give, to pay on basis of the hold over contract, to pay what is budgeted for 1992 FY, to ignore the contract, or to wait for the County to take the initiative. No decision was reached. Adoption of the Northwest Energy Code for 1990 will be considered at a joint Cities-County Public Hearing on Hednesday, December 18, at 7:00 P.M. at the Court House. Mayor Ard opened the Public Hearing to consider a request for a Special Use Permit to allow the LDS Church to build a Seminary adjacent to the Hillcrest High School on property zoned R-1. Notification of the hearing was published in The Post- Register on December 4, 1991. Notices of hearing were mailed to local radio stations, television stations, and property owners within 300 feet. The Planning and Zoning Commission held a Public Hearing to consider this request on December 3, 1991, and they received no public input for or against.
