Council Minutes 9/12/2006 (208) I I I Book 7-267 March 1, 1990 CITY OF AMMON March 1, 1990 Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7:30 P.M. by Mayor C. Bruce Ard with the following City Officials present: Mayor C. Bruce Ard Councilman Marvin J. Anderson Councilman Michael B. Browning Councilman Harvey Crandall Councilman Greg J. Maeser Engineer David E. Benton Public Works Director David City Clerk Aleen C. Jensen Wadsworth Others present: Michael Nye of Utah Power and Light Company Absent: Attorney W. Joe Anderson The pledge of allegiance to the flag was directed by Councilman Maeser, and the invocation was offered by Councilman Browning. Councilman Maeser moved to approve held February 15, 1990, as written. Browning. Roll call vote: Maeser - Yes; Yes. The motion carried unanimously. the minutes of City Council Meeting The motion was seconded by Councilman Browning - Yes; Anderson - Yes; Crandall - Michael Nye of Utah Power and Light Company's Shelley Office visited with the City Council about the service they supply. Councilman Browning reported on the flashing lights for the school crossings on Ammon Road which are fixed to the power poles. Mr. Nye inquired if the City of Ammon had discussed any more about the street light purchase program. The best option is for the City to buy the lights outright. This would greatly benefit the City financially. It was agreed to survey the existing lights to determine if additional ones are needed. After the needed lights are installed, the Council will consider a purchase program. Councilman Maeser reviewed the status of the request of Kay and MarJean Reiman, 3155 Rawson Street, for a Special Use Permit to enlarge their home, which is presently considered as a non-conforming use, by moving on a larger manufactured home. It has been determined, if the proposed unit can meet the Uniform Building Code and other requirements of the R-l zone, a Special Use Permit is not necessary and the City will issue a building permit. Time has been granted to the Reimans to have the unit inspected and obtain a certification that it meets code. Confusion about what the City requires has resulted. Councilman Maeser discussed the case with Steve Serr of Bonneville County Zoning, and it was recommended that the City of Ammon write a letter to the Reimans to specify the exact requirements. The letter should state that Bonneville County can not certify that the unit meets code and the Reimans must obtain certification from the manufacturer to show compliance with the Uniform Building Code, the State of Idaho electrical code, and the State of Idaho plumbing code. Copies of the letter should be mailed to Brett Manwaring, manufactured home dealer, and Steve Serr of Bonneville County. In regard to the City of Ammon's request for continuation of the basement exception in the flood plain, Engineer Benton reported the additional information had been submitted to Federal Emergency Management Agency, Bothell, Washington, for approval. During the preparation of this information, it was noted that the Peterson Park/Ross Avenue area now designated to be in the flood plain is possibly a fringe area. With a minimum of effort and documentation, it may be possible to get this area out of the flood plain, but such action is on hold until the basement exception is in place. There are problems with Ordinance No. 209 which amends the dog ordinance because all the previous amendments were not considered. Attorney Anderson recommended that we start over, and he will draft a new ordinance to include all the approved revisions. Following review by the City Council, Mayor Ard signed the Ammon Road Engineering Contract negotiated by the State Highway Department with Forsgren and Associates, Rexburg, Idaho, in the amount of $128,059.62 and the Notice to Proceed. Discussion continued on schedules, costs, right-of-way acquisition, and risks. The Postal Department has advertised for bids for a branch office to replace the one discontinued at Eastgate Drug. Numerous individuals have signed a petition to have the postal service restored. It is encouraging that the date to receive bids has been extended to March 9, 1990, and the area of consideration has been expanded to include a major portion of Ammon as well as that area previously identified. The area of solicitation reads, "Ammon-Lincoln Road west to St. Clair Road, South to Sunnyside Road, and North to 17th Street." 268 March 1, 1990 Bids have been received for replacement a new roof for the City Building. Reports: Public Works Director Wadswort checked on the snow machines at 2020 Falcon Drive. He counted three snow ma hines and Councilman Anderson observed five machines. Some park work is underway to trim trees and repair playground equipment. The spring-like days have caused more dogs to run at large and increased the need for an Animal Control officer to be on duty. At present, Julie Fergus n is off because of a work injury. She should be encouraged to come back to wor on light duty as soon as possible. In the meantime, other Public Works employes will do some patrolling to try to handle the dog problems. Mayor Ard advised the Council about a se er rob1em at 2600 Salmon Street. The new owner, Herbert B. Wine, has been ha ing trouble with the sewer, and it has been determined that only part of the ho se is connected to the City's sanitary sewer and part of the house is still conn cted to the old septic tank. The Wines have a real problem, but it is not the City's responsibility. The problem is I between the buyer and seller, and the e should be recourse through the real estate agent. Engineer Benton reviewed the plats for Council that Grobergs plan to extend building lots available for sale. They they continue development.
